DISTRICT ATTORNEY BONNIE DUMANIS PUBLIC CORRUPTION COVER UP EXPANDS IN 2010 - WITH MORE AUDIO TAPE EVIDENCE TAMPERING, AND MORE FALSE PROSECUTIONS OF AN INNOCENT MAN - PART II PART III
In 2009 and 2010 Oceanside Officer Damon Smith was not the only Oceanside Officer or Deputy District Attorney tampering with audio tape evidence, and being protected from investigation and prosecution, by DA Dumanis, the DA's Office, the Oceanside Police Department, and others. They already knew who OPD Officer Jon Domonique was, and that Domonique's audio tape evidence tampering was directly connected to another Deputy District Attorney named Daniel Rodriguez. DDA Rodriguez was also tampering with audio tape evidence in a criminal prosecution from Vista, CA. involving the County Sheriff's Department. Rodriguez was also being actively protected from arrest and prosecution to obstruct the Sommer $20 Million Dollar litigation against the DA's office. The DDA Marugg conspiracy to obstruct justice, and suppress criminal investigations, was also active in the DA's office in 2010. During the same time period, the Oceanside Chief Of Police Frank McCoy, was criminally conspiring with senior police officers to tamper with, and suppress audio tape evidence, in the Oceanside PD cover up and obstruction of the Sgt. David Larson DUI investigation.
THE CORRUPTION COVER UP HISTORY CONTINUES
In late October 2009, as the DA's conspiracy to obstruct justice in the Officer Damon Smith investigation was being sealed, more press releases were issued from District Attorney Bonnie Dumanis and Chief Frank McCoy. The press releases restated, that Oceanside Officer Damon Smith had done nothing wrong, and would not be prosecuted. The press release also falsely stated THERE WAS NO EVIDENCE OF OTHER OCEANSIDE POLICE OFFICERS INVOLVEMENT IN THE EIGHT YEARS OF AUDIO TAPE EVIDENCE TAMPERING, which was a coordinated criminal lie between the DA's office and the Oceanside Police Department. The Officer Smith investigation was quickly closed by DA Dumanis, with no further comment on all questions, to protect other ongoing criminal conspiracies within the DA's office. Once again, it was a self protecting criminal conspiracy from the DA's office and the Oceanside Police Department.

That self protection conspiracy operated at all levels of law enforcement. Between May 2008, and December 2010, this reporter used the Oceanside City Council public council meetngs to place public notifications, and documentation on the corruption, into the public record. This was done using the three minute public speaking access to city council meetings, and the Oceanside police and city council did not like it. In January 2010, Mayor Jim Wood initiated a police assault conspiracy, with Oceanside Police Officers to physically seize, assault, and remove citizens from council meetings, if they complained about the police and firefighter corruption. In March 2010, this reporter like previous oceanside citizens was targeted, and removed from the council chambers for asking questions about the civil rights violations, and the involvement of Mayor Wood and the council in covering up police evidence tampering and the election fraud. Complaints from citizens, linking the city council, and Mayor Wood, to the cover up of police evidence tampering, and election fraud, were not appreciated. This reporter was forcibly removed from the council meeting by police, and warned to not come back.
DA Dumanis, DDA Mosler, the DA's Office, and the Oceanside PD, had been given numerous complaints about the police assaults on citizens, between January and March of 2010, with no action, or response from DA Dumanis, or the DA's office.

THE DA's PUBLIC AGENCY CO-CONSPIRITORS IN 2009 & 2010
On November 3, 2009, this reported meet with Sgt. Ron Hardy, OPD Internal Affairs Supervisor, and CSO Ken Crossman, and filed formal written criminal, and misconduct complaints against Officer Damon Smith. The written complaints contains the witness identity info for Attorney Limberg, and Officer Smith's statements implicating other Oceanside Police Officers, in Smith's eight years of evidence tampering. The complaint filing process was recorded on audio tape for further verification.
On November 4, 2009 this reporter meet with DDA Damon Mosler, head of Special Operation and supervisor of DDA Laura Gunn, and filed a series of criminal complaints involving district attorneys, oceanside police officers, elected officials, and numerous political supporters. Complaints were filed for criminal conduct and misconduct, with written documentation, against Officer Damon Smith, and DDA Laura Gunn for obstruction of justice, evidence tampering, and suppressing a witness in the criminal investigation of Officer Smith. The complaint filling process was recorded on audio tape for verification. These complaints contained the witness Lynberg identity and contact information, and Officer Smith's statements implicating other Oceanside Police Officers in the eight years of evidence tampering.
On November 11, 2009, written complaints with copies of all DA documentation, were filed with Senior Assistant Attorney General Gary Schons, head of the San Diego AG's Office.
The Linberg witness information, and Smith's statements, was also provided in writing, and orally, to Mr. Henry Coker, head of the Public Defenders Office. Oceanside Chief Of Police Frank McCoy was given similar notifications, in public council sessions with the Oceanside City Council present.
In February of 2010, full written documentation, on the DA and Oceanside Police evidence tampering, witness suppression, and the Oceanside Police and Firefighter election fraud conspiracy, was also provided to Supervising Judge Joel Pressman, of the North County Superior Courts. The Superior Court System quickly drafted a short letter stating the courts had no authority to investigate anything.
All law enforcement public agencies quickly supported the public corruption, suppressed the complaints, the witness identity, and Officer Smith's statements implicating more Oceanside Police Officers in large scale evidence tampering. All public agencies avoided future contact, and refused all request for interviews.

EVIDENCE TAMPERING COVER UP CONSPIRACY EXPANDED IN 2010, WITH THE EXPOSURE OF MORE EVIDENCE TAMPERING BY ANOTHER OCEANSIDE OFFICER JON DOMONIQUE, AND A DDA NAMED DANIEL RODRIGUEZ
On March 25, 2010, the Oceanside Officer Jon Domonique audio tape evidence tampering surfaced with the NOT GUILTY VERDICT of a jury, and the receipt of an e-mail from victim Michael Shields. Shields was falsely arrest on felony assault in Janurary of 2009 and prosecuted, while the police audio tape evidence that would clear him, was hidden by police and DA's until the day trial started, in March of 2010.
Interviews with Mr. Shields and his attorney, and copies of the reports, evidence logs, and hidden audio tape, quickly connected Oceanside Officer Domonique's, & prosecuting DDA Daniel Rogriguez's audio tape evidence tampering cover up, with the April 2009 audio tape evidence tampering exposure of Officer Damon Smith, and its on going cover up. Both cases were being quietly suppressed inside the DA's Special Operations Division by DDA Damon Mosler through out 2009 & 2010.
GTI's investigation disclosed that, during the same time period, DDA Rogriguez's was also hiding audio tape evidence in the Shippee case out of Vista, CA. In late 2009, Rodriguez was quietly placed under suspension, pending investigation. Rodriguez was also removed from handling the Shields case at that time, where Officer Domonique was hiding audio tape evidence that would later clear Shields of all charges. The new DDA Elizabeth Silva continued to hide the audio tape evidence until the day of trial.

COVER UP "BLUE PRINT" OF VERY QUIET FORCED RESIGNATIONS
On April 23, 2010 this reporter did follow up contacts with DDA Damon Mosler, and requested information on criminal complaints filed on November 4, and February 9, 2009 involving DDA Laura Gunn, Officer Damon Smith, and others. DDA Mosler stated that DDA Laura Gunn "no longer worked for the District Attorney's office", and refused comment and interviews on all complaints, citing state personnel privacy laws, which has become the standard practice for obstructing investigations and covering up public corruption..
DDA mosler was given additional follow up information on the Officer Jon Domoniques evidence tampering with DDA Daniel Rodriguez. DDA Mosler continued to refuse comment on the striking similarities, on the handling, and investigation obstruction on all of the complaints. Mosler also stated he had no comment on the recent exposure of the DDA Rodriguez audio tape evidence tampering connections to Oceanside Officer Domonique. Mosler stated this reporter should contact the DA's special assistant Paul Levikow, regarding the Rodriguez questions, and ended the conversation. There was no comment, even though Mosler's Special Operations Division, had know about Officer Domonique and DDA Rodriquez evidence tampering for at least eight months.
This reporter attempted to contact District Attorney Dumanis for comment, and was forwarded to Paul Levikow, the Communications Director for DA Dumanis. Levikow refused comment on any of the criminal complaints, that had been previously filed with the DA's office, involving DDA Gunn or Oceanside Officer Smith. Levikow was also citing state personnel privacy laws, almost identical to those stated by DDA Mosler.
When Levikow was questioned on the Officer Dominique / DDA Rodriguez audio tape evidence tampering, Levikow once again stated that DDA Rodriquez, like DDA Gunn, "no longer worked for the DA's office". All questions were declined, and once again Levikow stated it was now a personnel matter, and state personnel privacy laws prohibited any further disclosure. When Levikow was questioned on the similarities of the DDA Gunn and DDA Rodriguez terminations, and their direct connections to the Oceanside Police Officer's Smith and Domonique's evidence tampering, Levikow became audibly irritated, and ended the interview.
As 2010 closed, all DA investigations of Officers Domonique and Smith, and DDA's Gunn and Rodriguez, for audio tape evidence tampering and obstruction of justice, were quickly and quietly shut down by the DA's Office, and all other law enforcement agencies. All criminal complaints and investigations were now sealed from press investigation, by the quiet termination / resignations of DDA's Gunn and Rodriguez. while state personnel privacy laws were systematically abused to suppress information, and cover up the criminal corruption.
THE DDA MARUGG CONSPIRACY TO OBSTRUCT JUSTICE "BLUE PRINT" E-MAIL, CATCHES DA'S OFFICE BY THE "BALLS"
It would be more than a year before the written hard evidence of the DA's Blue Print for the "Forced Resignation Conspiracy To Obstruct Justice" would surface. The evidence came from another 2010 corruption cover up criminal conspiracy, involving another DDA named Ernest Marugg. Another piece of 2010 DDA criminal corruption, that would have been a major liability to DA Dumanis and the DA's office, in their fight to get the Cynthia Sommer $20 Million Dollar lawsuit thrown out, or quietly settled and sealed, with a tax dollar payoff. A payoff with no criminal prosecutions of Dumanis, Gunn, Rodriquez, Marugg, or others. This investigation was also being handled by DDA Mosler's Special Operations Division, at the same time as the DDA Gunn and DDA Rogriguez corruption cover up.
In early 2010, DDA Marugg had been under investigation by the DA's Special Operations Division, on charges that Marugg has used his office, as a Deputy District Attorney, to pursue sexual affairs with women, that Marugg had preciously prosecuted for insurance fraud. It was later disclosed that the DA's office, had received a series of complaints from women, covering a ten year period of time, and there were thirty six witness to be interviewed.
On October 1, 2010, DDA Marugg quietly resigned from the DA's office, all evidence of a criminal investigation disappeared, and the DA's office stated DDA Marugg "no longer worked for the DA's office", and actively obstructed all inquiries, once again citing state laws on public employees privacy. Exactly like the DDA Gunn and the DDA Rodriguez resignations.

In November of 2011 the smoking gun evidence of the DA Office's Blue Print for conspiracy to obstruct justice, showed up in a civil court filing, in the McAnally case. The evidence was a "Privileged Attorney - Client Confidential Communication", between attorney Richard Castle, council for DDA Marugg, and the District Attorney's Office. A communication document that was normally protected by law, from disclosure under most circumstance, and was never intended to see the light of day in public.
The document, laid out in writing, the criminal conspiracy "BLUE PRINT" agreement between the DA's office and DDA Marugg, to obstruct justice. If DDA Marugg would quietly resign, the DA's office would drop all criminal investigations, and protect Marugg from future investigations, including the California Bar Association. A criminal conspiracy blue print identical to the corruption cover up already seen in the DDA Laura Gunn, and the DDA Daniel Rodriguez resignations, and the criminal conversion, of criminal investigtions, to a personnel problem, that could be protected, with false claims of state employee privacy laws.
November is a rainy month in California, and in November 2011, it just poured in more ways than one, on the DA's evidence tampering corruption cover up conspiracy, connected to the Oceanside Police Department, and Chief Frank McCoy.
In November 2011 the Oceanside Officer Garcia wrongful termination lawsuit was also filed. A lawsuit stating Chief McCoy, Capt. Grigsby, Sgt. Norton and other OPD Officers and staff had conspired to obstruct justice, and destroy audio tape evidence against another OPD Officer.
The court records, signed under penalty of perjury, exposed the start of another 2009 Oceanside Police audio tape evidence tampering conspracy. In August 2009 a high level Oceanside police criminal conspiracy to obstruct justice, in the police Sgt. David Larson DUI investigation was activated. The criminal conspirators named by Officer Garcia included Police Chief Frank McCoy, Capt. Reginald Grigsby, Sgt. Travis Norton, and Does 1 thru 20, which may not be enough Does, to cover all of the corrupt Oceanside cops.
The conspiracy was to destroy audio tape evidence, and suppress a police investigation, to protect police Sgt. David Larson from arrest and prosecution for Driving Under The Influence, giving false information to police officers involved in an investigation, and even littering, which would end the career of Oceanside Police Sgt. Larson. More importantly, any criminal investigation of Sgt. Larson would have attracted more attention to the active, and on going Officer Damon Smith and Officer Domonique evidence tampering cover ups, and the Oceanside police and firefighter election fraud conspiracy cover up.

The DA Office's response to the Oceanside Chief Of Police McCoy and senior officers conspiring to obstruct justice, once again involving audio tape evidence, was also quick and predictable. Garcia's attorney, Daniel Gilleon, stated that his request to the DA's office for a full investigation of Chief McCoy and the Oceanside Police Departmen were immediately rejected.
Additional confirmation on the long term, department wide obstruction of justice in the OPD, also came from the interview of Supervising Detective Matt Christenson, and the sworn statements of Oceanside Officer Gilbert Garcia's in his First Amended Complaint against the City of Oceanside, Chief McCoy, and others dated February 9, 2012.

The amended complaint added "Racketeering" allegations, also know as organized crime, to the lawsuit against the City of Oceanside, Chief Frank McCoy, Capt. Grigsby, and others, citing long term wide spread cover up of criminal conduct by "white" Oceanside Police Officers, while minorities were punished for the same crimes. The complaint also cites obstruction of justice by the City Attorney John P. Mullen, and others, and the San Diego District Attorney's Offices once again shows no evidence of invistigating anything, or any one.
