PUBLIC DEFENDER SLOAN OSTBYE, OBSTRUCTED THE OFFICER DAMON SMITH INVESTIGATION, AND SUPPRESSED A WITNESS TO THE INVOLVEMENT OF MORE OCEANSIDE POLICE OFFICERS IN EIGHT YEARS OF EVIDENCE TAMPERING IN CRIMINAL PROSECUTIONS
On October 22, 2009, the District Attorneys Officer announced the transfer of 37 of the Officer Damon Smith evidence tampering audio tapes, to the San Diego County Public Defenders Office. It is still not know how many audio evidence tapes Officer Smith recorded during the eight years period, how many were destroyed by Smith to avoid discovery, or the total number recovered and reviewed by the DA's office. It is also not know how many other Oceanside Police Officer were involved. These unanswered questions are a direct result of public corruption, obstruction, cover up, and secrecy, from the District Attorney's Special Operations Division, and the Oceanside Police Department. The DA's Office and Oceanside Police, both refused to answer questions from the media, citing on going investigations, personal information on peace officers, and non-disclosure in the best interest of the public.
At the same time both agencies are releasing prepared statement, that Officer Smith has done nothing wrong, and will not be prosecuted. The planned corruption is a two sided joker card, intended to suppress the investigations, minimize the number of notifications to defense attorneys, and protect eight years of corrupted prosecutions from a real investigation.
The Public Defenders Office announced that Public Defender Sloan Ostbey had been appointed to head up the PD Office's investigation of 37 of the Officer Smith audio evidence tapes, released by the District Attorney's Office. Specific information on the remaining tapes was declined by the DA's Office. All legal Public Information request, over a period of several months, to all agencies including the Public Defenders Office, were suppressed and ignored. All attempts to follow up with PD Henry Coker, head of the Public Defenders Office were blocked.
On February 1, 2010, with no response from PD Coker, PD Sloan Ostbey was contacted. PD Ostbey was declining press comment, citing an ongoing investigation. Ostbey was questioned about the witness Andrew Lynberg information, provided to her boss, Henry Coker, on October 26, 2009. PD Ostbey had no knowledge of any witness, to the involvement of more Oceanside Police Officers, in the Officer Damon Smith Evidence Tampering. Critical witness information, impacting hundreds of criminal prosecutions in the Public Defenders Office, had been suppressed from the investigation, by the head of the Public Defenders Office, Henry Coker.
The witness Lynberg information was then given to PD Ostbey, and extensive hard copy documentation was hand delivered to her office on 2-5-10. PD Ostbey stated that a full investigation of the witness Lynberg information would be done. PD Ostbey was also given supporting documentation on the Officer Jon Domonique evidence tampering.

On 4-2-10, PD Ostbey was contacted regarding the Officer Jon Domonique evidence tampering, and to follow up on the Officer Damon Smith evidence tampering investigations. PD Ostbey stated she had heard about the false prosecution of Michael Shield in the Officer Domonique evidence tampering, however, Ostbey stated she had not heard about the involvement of DDA Daniel Rodriquez. PD Ostbey was also advised about the obstruction of justice, and witness tampering by DDA Laura Gunn in the Damon Smith evidence tampering. PD Ostbey requested that full written documentation be forwarded to her office, which was done. All phone attempts to follow up with PD Ostbey, and PD Coker between April 2010 and November 2010 were declined.
On November 4, 2010, Witness Andrew Lynberg was contacted. Witness Lynberg stated that he had never been contacted by any agency, or investigator, since that first day in April of 2009 when he discovered the Officer Damon Smith evidence tampering. PD Ostbey had buried the witness, and avoided calling Lynberg about Officer Smith's statements involving other Oceanside Police Officers in the eight years of evidence tampering in criminal investigations.
All law enforcement agencies, including the District Attorney's Office, the Oceanside Police, the Attorney General's Office, and even the San Diego Public Defenders Office, had joined the public corruption conspiracy to cover up eight years of massive evidence tampering, obstruction of justice, fraud, perjury, criminal assaults on citizens, and false arrest and false prosecutions of innocent citizens.
