The Oceanside Police, Firefighters, and City Council Members all knew about the criminal conspiracy and election fraud, and they all participated in the cover up during, and after, the election fraud. Even Council Member Jerome Kern, the target of the conspiracy, joined the cover up after the recall conspiracy failed to remove him from office, while CM Chavez was forced to resign or be bankrupted by the organized public corruption.
CM Chavez's sudden resignation allowed previously rejected FFA and POA candidate Charles Lowery, to take Chavez's seat for six months, while CM Kern and CM Feller protected their future political careers from the Oceanside Firefighters and Police unions, with silence and cover up. However, that was all the time the unions needed to defraud the citizens of Oceanside of millions of dollars, for years to come.
FIRST RESPONDER UNION FRUSTRATION DRIVES PUBLIC CORRUPTION PLANNING
For many years the First Responders Public Union’s battlefield, for unrestricted access to citizen’s tax dollars, has been the control of elected officials, and their votes on union contracts. Nowhere is this battle more evident, or more corrupt, than the City of Oceanside, where the public union’s tactics have become very dirty, and very criminal.
The battlefield is anything but, a level playing field. The criminal organization money bag is the Oceanside Firefighters, and the protection enforcers, are the Police Officers, the District Attorney's Office, and corrupt council members. Even the Attorney General's Office & the Governor's Office are connected to the cover up, to protect their own union money sources, from the same unions financing the election fraud.
The City of Oceanside is one of the few cities in the county, that does not have limits on financial donations to local election campaigns. This lack of donation limits, gives the collective financial power of the Firefighter and Police union candidates, a significant advantage over the average citizen in City Council Elections. Even with this financial advantage, the Firefighter and Police unions have had difficulty maintaining a three vote control in the City Council. A vote control which is critical for union contract negotiations, and new expanded union contract approvals. The next Fire & Police contract vote was scheduled for January of 2010. At that point in time they did not have control over the city council vote, and there were no scheduled elections before the new contract vote.
HOW PUBLIC UNIONS BANKRUPT CITIES
In 2004 the Oceanside Fire & Police unions massive campaign financing had purchased only two solid votes in Council Member’s Jim Wood, an X-OPD Officer, and Democrat Ester Sanchez (Public Defender Attorney). These two council members have consistently voted to expand union pay and benefits, and are consistently the recipients of substantial campaign financing, and unlimited protection, from the Police and Fire Unions. The campaign financing comes in through the front and back doors, of re-election campaigns. In the November 2004 council elections, pro union council member Jim Wood was elected to be Mayor, while other union supported candidates were defeated. Wood's election to Mayor opened a council seat, and left the council with a two vote split, relative to union control of the council votes, especially on union contracts.
A three vote majority was required to name a replacement for the open seat, however, when no majority agreement could be reached, a special election was scheduled and held in 2005. The Fire and Police Unions provided substantial campaign financing for pro union candidates Shari Mackin and Charles Lowery. Lowery lost, while Shari Mackin was elected to fill the remaining term of now Mayor Wood's vacated council seat. This provided a three vote union majority with Mackin, Sanchez, and Mayor Wood, that were controlled by the police and fire unions money.
The OFA and POA unions wanted to enhance their financial position to control future elections, and limit citizen access. So one of the first things that was done by the new pro union majority, was to pass ordinances that severely limited citizen supported lobbyist involvement in local politics. However, the ordinance exempted the Oceanside Police and Fire unions, from the same strict financing controls. This discrimination would set up an extremely uneven playing field, in favor of the police and fire unions, with no limits on campaign contributions, and restricted citizen opposition. This was the first step by the police and fire unions to set up future manipulation of votes, and elections, through financial dominance, and criminal conspiracy to tamper with, and manipulate elections.

In the November 2006 regular council election, the Fire and Police Unions heavily financed the re-election campaign of Shari Mackin, and once again the election campaign of Charles Lowery. Both candidates lost to Jerome Kern, who was not a guaranteed pro union vote. This has since proved to be the case based on his documented voting record.
Council member’s Kern, Chavez, and Feller became a new voting majority that did not put the Fire & Police Unions financial interest ahead of the citizens of Oceanside. This election removed the pro union majority vote from the City Council again, and there would not be another scheduled election prior to the January 2010 vote, on a new union contract.
In 2008, with a large city budget deficit, the new majority voting trio of Council member’s Kern, Chavez, and Feller, opposed the funding of three new firefighter positions. Against heavy Fire & Police union opposition, Council member Kern went on to recommend the privatization of other fire department services, to save tax dollars, and reduce the budget deficit. These events were the red flags that set into motion the Firefighters and Police Union conspiracy, to illegally manipulate the votes of citizens, remove Council member Kern, and replace him with the pro union voter Charles Lowery, before the January 2010 vote on a new union contract.
The Council push by Kern, Feller, and Chavez, for spending and personnel cuts in the Police and Fire Unions, and the privatization of some of the police and fire services to same money, sent a financial shock wave through the police and fire departments, and unions through out the State. Loss of union personnel, and services, would reduce the union finances, and their associated capabilities to finance and manipulate elections. There was no apparent legal way to get control over the council vote, before January 2010, so the Police & Fire Unions conspired to do it the illegal way.
THE ELECTION CONSPIRACY PLANNING
Campaign finance records from the city clerk’s office show the Police & Firefighter conspiracy to recall Kern, and replace him with a sure thing union yes vote, was well underway in the latter half of 2008. As of December 2008 the OFA Union had collected $36,081.37 from the Police Officers, and $67,600.00 from the Firefighters for a total of $99,000.00+. The Firefighters Union then donated money, using both cash and back door non-monetary contribution to support the council election campaigns of long term union supporters Charles Lowery and Rex Martin.
Additional money went to the re-election PAC's of Mayor Wood, and Deputy Mayor Sanchez, even though there was no scheduled council elections until November of 2010, which would be after the scheduled union contract vote in January 2010. The non-monetary independent expenditures, shown as supporting Mayor Wood and Deputy Mayor Sanchez, were used by the OFA to prepare and pay for the development, and distribution of falsified campaign literature designed to illegally manipulate the votes of citizens, in the planed recall election petition drive. Lowery and Martin, would become the candidates running to replace Kern, if the secretly planned recall conspiracy was successful.
The FFA set up "STRAW PAC's, using obscure existing PAC's, controlled by long term union supporters. This early planning clearly indicated the conspiracy plan required taking advantage of the six month reporting time schedules of long term PACs, for state campaign finance reports. Multiple PAC's and individuals, controlled by the unions, would falsify campaign finance records, and manipulate PAC filing dates, to hide the union financial control.
This would allow the unions to print and distribute the falsified campaign literature to manipulate votes, and hide that fraud until after a council vote, set up by union supporter Mayor Wood, could be set to approve the fraudulent petition drive. The State mandated six month reporting cycle for PAC's could also be used to hide payments to a private petition drive company, to replace citizens, and streamline signature collections, while the falsified campaign literature was distributed to manipulate citizen votes. Campaign finance records are signed under penalty of perjury, and if two or more people are involved, it is criminal conspiracy (CPC 182).
The primary objectives of the Firefighters & Police Union election fraud conspiracy were:1. To hide the Firefighters and Police Union’s total financial control over the recall election process long enough to manipulate citizen recall petition drive votes, the City Council acceptance of the petition signatures, and the recall election Council approval, if the signature drive was successful.
2. Use the six month reporting cycles to hide recall criminal operations and minimize the time available for any citizen opposition groups to form, and start any effective opposition to the fraudulent recall signature drive, once the petition drive became public.
3. Covertly select and finance a private company (The La Jolla Group) to execute the signature petition drive as early as possible in January 2009, to take maximum advantage of the 6 month campaign finance reporting cycles to black out news media and public access to union campaign finance information for six months.
4. Secretly, and illegally, coordinate the money flow from the Police, Firefighters, and their public unions, illegaly through and around multiple PAC's including the newly formed Kern Recall committee, to start the commercial signature drive, without raising any red flags, that would provide a tip off to potential citizen opposition.
5. Set up and coordinate a media blitz of falsified campaign literature, to illegally manipulate the citizens petition votes, and the city council petition drive approval votes, to set an election date, before the release of campaign finance records in July 2009. Continue the fraudulent media blitz through the recall election to manipulate votes in the general election.
6. If the conspiracy was detected by citizens, the Police department would suppress all complaints and investigations, with the support of Mayor Wood and Deputy Mayor Sanchez.
The criminal scheme was perfect, because it was protected from investigation and prosecution, by local police, the DA's office, and the State and Federal Justice Departments, because all the criminals were wearing badges.

THE CONSPIRACY TIME LINE
OFA Campaign finance records for 2008 and 2009 show that in the last quarter of 2008, the Firefighters Union set up the First Money Channel, of a three channel ILLEGAL money system, designed to hide the unions financial control over the planned ILLEGAL manipulation of citizens votes. The OFA campaign finance records (CFR's) show that "Independent Expenditures", or direct payments to suppliers, exceeding $33,000.00, had been made for North County Times Ads, Mailers, and Signs, using three key political action committees (PAC's) as cover.
The payments were shown as being made on behalf of the election committee for Charles Lowery, and the re-election committees of Mayor Jim Wood, and Deputy Mayor Esther Sanchez. Neither Wood or Sanchez was running for re-election until 2012.
The money was to finance the initial production and eventual distribution of fraudulent campaign literature, designed to manipulate citizen votes in the still undisclosed Recall Election, and petition drive, and to support the election campaigns of Union "STRAW CANDIDATE" Lowery and Martin, to replace Kern.
The January filing of the Kern Recall Committee would place the start of the recall election just inside, the start of the six month reporting cycle for long term campaign finance reports. The distribution of the falsified election literature, would be coordinated with the activation of the recall election, and the petition drive, for maximum effect, as new PAC's were limited to a 3 month reporting requirement.
FIREFIGHTERS 2008 - 2009 CAMPAIGN FINANCE RECORDS - AN ILLUSTRATED MAP OF FIRST RESPONDER CRIMINAL CONSPIRACY AND PUBLIC CORRUPTION
On January 23, 2009 the Firefighters Union activated the Second Illegal Covert Money Channel to support the falsified campaign literature, and activate the fraudulent petition drive. The OFA paid $5,000.00 to the STRAW PAC "Committee to Protect and Preserve Parks and Beaches". The OFA needed to secretly get enough money into the Kern Recall committee, without the OFA money showing up in the shorter 90 day campaign finance reporting cycle, of the newly filed Kern Recall committee. The newly filed Kern Recall committee was broke. It required enough money, with no union fingerprints, for a deposit to set up the contract with the San Diego based La Jolla Group, and activate the commercial signature drive. This had to be done without tipping off citizens to the falsified campaign literature that was in direct conflict with the union financing a private company to run the petition drive.
The Parks and Beaches committee officers were former council member Shari Mackin, and Christine Gow, two long term supporters of the Firefighters and Police Unions. This P&B committee, as a long established PAC committee, had a six month campaign finance reporting requirement like the OFA, and the conspiracy required at least six months to manipulate the petition drive votes, and gather enough signatures to put the recall on the ballot, before anyone would be able to look at the campaign finance records of the OFA, or the Parks and Beaches PAC's, if anyone was looking.
Criminal Conspiracies by their nature are designed to be secret. The devil, in detecting any conspiracy, is always in the details, that the conspirators overlooked, or could not control once the conspiracy was activated. The Parks and Beaches committee was also broke in January of 2009, and only had a little over $500 in their account. The OFA $5000.00 donation immediately exceeded 80% of the finances of the P&B committee. This activated State laws requiring the committee to identify the financial sponsorship of the Firefighters Union in the title of the campaign finance records, and all subsequent associated donations, documents, ads, flyer's, etc. This required notification was not done, and subsequent campaign finance reports were also falsified by Shari Mackin, and Christine Gow to hide the donation source, being the Firefighters Union. Falsification of any Public Records is criminal conduct, signed under penalty of perjury, and even worse when the falsification is done in furtherance of a conspiracy (Penal Code Sec. 182) to tamper with an election, and manipulate the votes of citizens thru fraudulent information.
Three days later on January 26, the new PAC “Citizens To Recall Kern For Fair And Balanced Government” filed their documents with the City Clerk. The fire and police unions $5000.00, along with Christine Gow as an officer, was transferred from the Parks and Beaches Committee, to the Kern Recall Committee. The Kern Recall committee as a newly formed PAC, was on a 90 day finance reporting requirement. This is why the money was illegally channeled through the Parks and Beaches committee in the first place. The OFA needed to hide the OFA control for at least six months, in the hope that no one would notice, once the recall elections was on the ballot, but once again the plan fell short.
The Police and Firefighter unions $5000.00 arrival in the Kern Recall committee, immediately exceeded the 80% state mandated rule requiring disclosure of OFA sponsorship, by the Kern Recall Committee for the donation. Christine Gow, not only came with the money from the Parks & Beaches Committee, she also brought the knowledge of the source of the money, being the Firefighters Union.
As in the Parks and Beaches committee, this $5000 donation, again activated a state law requiring the Kern recall committee to identify the sponsorship of the Firefighters Union in the title of the campaign finance records, and all subsequent associated documents, ads, flyer's, etc. This notification was not done again, and subsequent campaign finance reports were falsified by Christine Gow, and Carolyn Krammer (former campaign manager for former Council Member Mackin) to hide the source of the money being the OFA, and support the falsified campaign literature designed to manipulate citizen votes. Once again committee members conspired to falsified Public Records under penalty of perjury, which is criminal conduct, and even worse when the falsification is done in furtherance of a conspiracy to tamper with an election, and manipulate the votes of citizens.
The OFA $5000.00 to the Kern Recall committee was then paid to The La Jolla Group, as a down payment on the Kern Recall petition signature drive. The La Jolla Group is a commercial company in San Diego with a specialty in providing commercial campaign petition signature drives, which do not require the time consuming process of organizing citizen volunteer groups, or the participation of Oceanside citizens in any way.
The evidence that the OFA $5000.00 was always intended to be used, to quietly set up the petition signature drive, without citizens becoming aware that the Firefighters Union's conspiracy was in financial control, also comes from the late release of OFA campaign finance records. Violating State Laws again.
When the Kern Recall committee used the OFA $5,000.00 as a deposit to activate the contract with the La Jolla Group, it also activated the OFA Third illegal Money Channel. Once the contract deposit was made by the Kern Recall PAC, the OFA then made an additional direct payment of $20,889.00 to the La Jolla Group to seal the contract, and start the commercial petition drive. This payments could be, and was hidden, for six months inside the OFA records. Record that then had to be filed late in violation of State laws, after the City Council vote on the petition signature drive, to approve the recall election was unexpectedly delayed.
The coordinated flow of illegal money from one source, the OFA, through multiple PAC channels to the same destination, the La Jolla Group, with the coordinated falsification of campaign finance records, and fraudulent campaign literature, is the kind of criminal conspiracy evidence that honest District Attorneys dream about. However, there were no honest district attorneys to be found in San Diego County. All criminal complaints were suppressed, without investigation, to protect other ongoing criminal operations between the DA's office and the Oceanside Police Officers that were criminally manipulating the election recall.

In April 2009, in the middle of the election conspiracy, the Oceanside Officer Damon Smith Evidence tampering was exposed in the North County Courts, and quickly covered up by the Oceanside Police and the San Diego District Attorney's office. This was done in part to protect the on going election fraud conspiracy. As it could expose other on going criminal operations, and conspiracies, directly involving the Oceanside Police Department, and multiple Deputy District Attorneys, including DA Dumanis, and the DA's Office.

The Oceanside Firefighters Union records, for the first half of 2009 were eventually filed late with falsified July date stamps, that were later corrected to August 20, 2009 on orders from the city clerk. The date stamps had been manipulated to hide the late filings. This was almost a month behind the state required reporting date of July 31. This was done to keep the release of OFA financial information secret, until after the illegally obtained petition signatures were submitted to the council to set a recall election date. Charles Lowery also delayed the first release of his campaign finance records until July 28 to support the police and fire conspiracy to hide the money trail until after the council had approved the signature petition drive results.
The falsified first quarter Kern Recall campaign finance records were also hastily updated in August to reflect the required Firefighters Union sponsorship, and hide the election fraud. These record updates were a direct result of various editorial news media sources, citizens complaints, and GTI News notifications on the election fraud. The media editorial reports started occurring during late April and early May, but showed no evidence of any real media investigations. The OFA union story line was changed after the August late submission of falsified CFR's were detected. The new union story line was the Firefighters Union was just supporting the senior citizens that were recalling Kern, while continuing to keep their financial records secret.
After the falsified Kern Recall first quarter reports were filed, the Firefighters Union then donated an additional $20,000 in cash, between May 3, and May 20 to the Kern Recall committee. This $20,000 was then paid by the Kern Recall committee to the La Jolla Group who was handling the signature drive. This was the third coordinated money payment from the OFA Union to the same destination, the La Jolla Group. Payments for the same petition drive contract, while the Parks and Beaches Committee and the Kern Recall Committee falsified their records to hid the money source being the OFA. A conspiracy operated to support the distribution of the OFA's falsified campaign literature. The OFA total expenditures to the La Jolla Group are now in excess of $45,000.00 dollars and 100% of the cost of the commercial signature drive.
As stated above, this is the kind of criminal conspiracy evidence that honest District Attorneys normally dream about, except when the criminals are cops and firefighters, and the District Attorney's Office is desperately trying to avoid criminal prosecutions of DDA's including DA Dumanis for prosecutorial misconduct, and twenty million dollars in civil damages for other public corruption.
THE UNION KERN RECALL PUBLIC CORRUPTION CRIMINAL LIE
During 2009 more than $193,000.00 dollars went through the Kern Recall Committee with only one citizen contribution of $125.00. More than a $193,000.00 came from the Oceanside Firefighters, Police Officers, their unions, and eventually 3 other outside supporting unions. In the final months of the election fraud conspiracy, as Police and Firefighter financial resources were running low, the United Here Unions stepped in with $68,852.45 for campaign literature, wages, etc. The AFL-CIO San Diego Imperial Counties Labor Council provided an additional $9,628.70 for phone bank operations, wages, food, etc. This provided an additional $78,000.00 plus for the OFA to continue the election fraud conspiracy. The Orange County Firefighters Union provided an additional $15,000 loan to support the Oceanside Firefighter and Police criminal conspiracy.

The additional money that was provided to Mayor Wood and Council member Sanchez, even though they were not up for re-election in the next term, was done to insure their continued protection, and support in the City Council should any problems or citizen complaints arise. Mayor Wood and Council Member Sanchez opposed, and dismissed all complaints, and citizen calls for criminal investigations. CM Kern was under direct attack in the recall election, and CM Chavez had been under financial and personal attack from Mayor Wood and Deputy Mayor Sanchez for years. The message was clear, step out of line and the police and fire departments will crush you, and your family.

The campaign literature statements is a series of lies, and criminal election fraud. The three channel, illegal money trails, documented in the campaign finance records clearly show that the entire recall process was a criminal conspiracy planned, executed, and financed by the police and fire unions, three outside unions, a few union supporters in key PAC committees, and key City Council Members. The signature drive was planned from the beginning to exclude citizen involvement. The fraudulent media blitz was planned and executed to support the illegal manipulation of PAC records, and citizens votes.
MORE CAMPAIGN FINANCE FRAUD
The Firefighters and Police Unions conspiracy also coordinated the delayed filing of their falsified campaign finance reports until August 20, 2009. This was done in violation of campaign finance laws to facilitate the manipulation of the votes of non pro union council members. This was almost a month behind the normal July 31 filing date limit. This became necessary, when the required number of signature petitions was not completed early enough to submit documentation to the city council in July, for approval of the petition drive, and start the election date setting process.
If the Firefighter and Police Unions financial information was investigated before the council vote, it would have provided strong evidence that the Firefighters and Police Unions had criminally conspired to falsify, and tamper with the petition drive. Petition drive corruption and falsified public records evidence, submitted to a non-union vote majority council, could have provided legal cause to deny the council approval of the signature drive, and tanked the entire conspiracy.
The Firefighters Union also knew from the beginning, that in order to get a recall election date set, before the council vote on a new contract in January 2010, they had to have a recall election date set before the 2009 Christmas Holidays. In order to guarantee a recall election date in November or early December 2009, taking into account mandated time restrictions, the completed signatures had to be submitted to the city council, and approved before the July campaign finance filing deadlines. The council approval was delayed until August 12, as no council meetings were available in late July, so the campaign finance records were held back until late August, after the council vote, and then submitted to the clerks office, with falsified filing dates to hide the criminal fraud conspiracy.
The only way to organize and complete a signature drive, with minimal citizen opposition, within the limited time between January and July, is to eliminate the involvement of the citizens, and manipulate their votes. That is why the Firefighters Union wanted to secretly hire the La Jolla Group, a commercial petition signature company. The evidence shows that the Fire Union with the financial support and protection of the Police Union, executed a criminal conspiracy to manipulate the votes of citizens, and tamper with an election to improve their pay and benefits. The criminal fraud initial cost to the citizens of Oceanside, for the special election, was estimated at $500,0000.00. This does not include the cost to citizens to fight the fraudulent special election, and the city already had a projected deficit in the millions. Mostly due to the existing financial obligations to the police and fire department union contracts.

The Police and DA cover up was to protect more than the election fraud. It was also to protect large scale Oceanside Police and DA evidence tampering, in criminal arrest and prosecutions, that surfaced in the middle of the election fraud. Police and District Attorney evidence tampering cover ups that would have exposed and derailed the election conspiracy, sent many people to prison, and destroyed DA Dumanis's run for San Diego Mayor.

Council Member Kern survived the recall conspiracy, however, his backbone, and that of Council Members Feller and Chavez did not. The Police and Fire Departments financial and personal assaults, and the associated intimidation, silenced all three council members, when it came to complaints from citizens about police and firefighter public corruption.
Immediately after the recall election, Council Member Rocky Chavez ran for cover, resigned, and took a job with the state veterans administration. Kern and Feller have remained quiet following the election fraud, police and firefighter corruption, and through out the extensive Police and DA evidence tampering conspiracies. Chavez's immediate resignation abandoned the citizens of Oceanside, and our veterans, and set up a second opportunity for the Police and Fire Departments to restructure the council vote before the new union contract vote, and it was successful. As usual the politicians keep their jobs, the unions get the fillet steak, and the citizens get the feed bill.
UPDATES
A special election vote held in June 2010 to fill Chavez's abandoned council seat resulted in Charles Lowery being elected by a very narrow margin. Lowery then provide what the Police and Fire conspiracy was all about, that third vote, on a new expanded police and fire contract that could bankrupt the citizens of Oceanside. The new contract leaves the citizens of Oceanside in extreme debt, with an organized crime public safety system, that cannot be trusted to follow the law. The new union contract also signed over citizen staffing controls to the fire department. The firefighters wanted to make sure any future council changes would not impact their union finances for the life of the contract.
