Oceanside Police Officer Jon Domonique - DDA Rodriguez Audio Tape Evidence Tampering Conspiracy

An Innocent Man (And His Family) Criminally Prosecuted To Cover Up Massive Evidence Tampering, Election Fraud, And Obstruction Of Justice, By Oceanside Police And The District Attorney's Office.

THE VICTIM & THE FALSE PROSECUTION

On the morning of February 25, 2009 Mike Shields, and his family, had no idea that he would be arrested for a felony crime, he did not commit, and prosecuted to cover up extensive police and district attorney evidence tampering, conspiracy, obstruction of justice, election fraud, and other felony criminal conduct, by police and district attorneys. The deck of public corruption was stacked against Mike Shields and his family, before he even got out of bed that morning in February 2009. The deck was not only stacked, it was well greased with stolen tax dollars, from extensive public criminal corruption.

The objective of the corruption was to control the access to, and use of hundreds of millions of dollars in tax payer money by police, district attorneys, firemen, Superior Court Judges, their public unions, and public officials, protecting the scheme in exchange for campaign finance money. The political Oceanside City Council support was driven by greed, and fear of retaliation, from the Police, and Firemen, and their powerful well financed unions.

Shields stated that about 3 months after the arrest, Shields and his attorney David Bortje, meet with Deputy District Attorney Daniel Rodriguez. Shields and Bortje were requesting a copy of the audio tape statement that Shield had given to Officer Domonique the night of his arrest for Assault With A Deadly Weapon. This was the first of many request, to multiple District Attorneys according to Shields. Each time the request was made, the District Attorney's Office stated that the DA's office, and the Oceanside Police, had no knowledge of any audio tape statement, taken from Shields, by Officer Domonique. For the next seven months DDA Rodriguez, and later DDA Silva would deny the existence of the audio tape, and push Mike Shields to plead guilty, in exchange for reduced time in prison, for a crime he did not commit.

Daniel-RodriguezIn August 2009 DDA Rodriquez was caught withholding more audio tape evidence in the "People V. Shippee" case in the Vista, California Superior Courts. Three men were arrested and charged with rape and kidnap, among other crimes. The audio tape statement, and written document evidence that was hidden, was the victim's statements.

Statements that indicated the men were over charged in the case, and there was no rape or kidnap. However, while DDA Rodriguez hid the victims audio tape evidence, and statements that could clear the young men of many of the charges, Rodriguez pushed the defendants to plead guilty, to crimes they did not commit, in exchange for less jail time. Just like DDA Rodriguez was doing in the Shields prosecution in the neighboring city of Oceanside.

When the news media reported on the Rodriquez corruption, he was suspended from the DA's Office pending investigation, and removed from the prosecution of the Shields case. Rodriguez was later, quietly terminated, and quickly declared a personnel problem to shut down criminal complaints and investigations, against DDA Rodriguez, the Oceanside Police, and the DA's office. The DA's office, as in the Officer Damon Smith evidence tampering, was protecting other on going corrupted prosecutions, involving Rodriguez, and other DDA's, from new investigations and prosecutions.

DDA Rodriguez was replaced by DDA Elizabeth Silva. DDA Silva continued to deny the existence of any audio tape statement, taken by Officer Domonique of the Oceanside Police Department, and continued pushing for a guilty plea from Shields, right up to the day of trial. It would be standard procedure for DDA Silva to be briefed on the circumstances of assuming a prosecution in the middle of the case, and according to Shields, DDA Silva was also questioned about the missing audio tape statement.

In March of 2010 as the trial was starting, Shields maintained his claim of innocence, and would not plead guilty. Shields stated, that he and his family were terrified of the prospect of going to prison. Shields even contemplated suicide out of pure fear. Only at the last minute, when Officer Jon Dominique was faced with taking the stand, under oath, and answering questions about the missing audio tape statement, did the police, DA conspiracy start to unravel.

Surprise, Surprise!!!

DDA Silva suddenly has the audio tape statement. The audio tape that the District Attorney's Office, and the Oceanside Police, had been denying the existence of for almost a year. A tape that proves the innocence of Mike Shields, and the jury agreed, with a not guilty on all counts.

DDA Silva reportedly told Judge Maino that she had only noticed a notation in the OPD Report, at the last moment, regarding an "audio tape CD". Which Silva retrieved, and provided to Shields Attorney. Although there is no "audio CD" notation in the police report, and this reporter has an un-redacted copy of that report. The only mention of a CD in the OPD report is in the evidence log for the CSI site photo images. Either Silva lied about the notation, or it was added just before trial started, as the report produce to Shields Attorney just before trial does not mention an "audio CD".

Shields stated that DDA Silva claimed that she did not know the tape had been hidden, and that Silva had reportedly "read the riot act", to Officer Jon Domonique for hiding the tape. As soon as DDA Silva stopped denying knowledge of the evidence suppression, she started arguing the legal position, to the court, that the audio tape statement should be suppressed, as hearsay. The court denied the request. The jury listened to the tape and came back with a Not Guilty on all counts. There was no mention of Officer Domonique's criminal conduct in hiding evidence of innosence in a felony prosecution.

JUDGE CRIMINAL CORRUPTION

JUDGE-RUNSTON-MAINOThe Superior Court Judge Runston G. Maino, handling the Shield's trial, knew the DA's Office, and the Oceanside Police had obstructed justice, hiding evidence, and the Judge did nothing. Additional investigation would disclose Judge Maino, and other Judges were criminal involvement at that point in time, in other Oceanside PD, and DA conspiracies to obstruct justice.

DDA Silva knew that the audio tape was smoking gun evidence of felony criminal conduct by Officer Jon Domonique and DDA Daniel Rodriguez. Silva had replaced DDA Rodriguez, when he was suspended for exactly the same type of criminal evidence tampering in the Shippee case. The DA's and Police once again were hiding audio tape evidence, just like the Officer Damon Smith eight year evidence tampering spree, while they pushed an innocent man to take a plea bargain for less prison time, on a crime he did not commit.

 

 

The Criminal Cover Up

OPD CRIMINAL COMPLAINT #10006794 AGAINST OFFICER DOMONIQUE BURIED BY OCEANSIDE POLICE & THE SAN DIEGO DISTRICT ATTORNEYS OFFICE TO PROTECT ONGOING CRIMINAL OPERATIONS

The District Attorneys Office knew that the only way to keep the Officer Domonique, and DDA Rodriguez evidence tampering quiet, was to force a plea bargain, before anyone found out about the suppressed audio tape statement. A plea bargain would allow the suppressed audio tape statement to remain missing, and the criminal conduct of multiple DDA's and Oceanside Police officers could be buried, as usual.

Oceanside Officer Jon Domonique's negligent field investigation of a traffic accident, resulted in the false felony arrest of Mike Shields. As Officer Domonique took the audio statement, he realized that he had the victim under arrest, and there was no assault with a deadly weapon. Officer Domonique had two choices.

  1. Domonique could report to his superiors that he had been negligent in his field investigation, and made a false felony arrest of the victim, which was not supported by the evidence, and that would not be good for Officer Dominique’s career with the OPD.

  2. Or, Domonique could hide the audio tape statement, falsify his felony police report, and allow an innocent man to be prosecuted, with the knowledge that most cases of this type are always pushed to plea bargain before trial.

Officer Dominique chose to hide the audio tape, and the evidence of time has shown that hiding audio tape evidence is very common in the Oceanside Police Department, the San Diego District Attorneys Office, and other agencies.

Officer Domonique then omitted all references from the police report, that an audio statement had been taken, and limited the information placed in the report to insure a successful prosecution of Shields.  Officer Dominique omitted extensive critical information that would clear an innocent man of a felony charge

The all out criminal assault on the Mike Shields family, destroyed him financially and emotionally. All of Mike Shields college saving was spent on a criminal defense attorney. His marriage and family relationships stressed to the breaking limits, while dirty cops and dirty DA's once again hid the evidence that would clear an innocent man.

At present the Shields family is being sued in civil court by the suspect, that filed the false charges against Mike Shields. The suspect is using the falsified police arrest report as evidence, while the Oceanside Police, City Council, and District Attorney Dumanis circle the wagons to suppress all information, complaints, and investigations of the public corruption. All to avoid civil litigation damages, and prison. Just when you think it could not get any worse, it does.

The Hidden Superior Court Corruption

JUDGE-RUNSTON-MAINO The judge hearing the Shields case, Runston G. Maino, was actively involved in another DA - Oceanside Police conspiracy to cover up the felony crimes, of other DDA's and Oceanside Police Officers at the same time. Judge Maino knew the DA's and Police had hid the evidence in the Shields case until the trial started, and he did nothing, to expose the DA and police crimes to protect himself from prison time.

REPORTERS NOTES:

This reporter is a former police officer from two different California cities. I have zero tolerance for corruption in any public safety agency. I reviewed the police reports prepared by Officer Domonique, the transcript of the hidden audio tape, and interviewed a CHP independent expert, accident investigator, on the Shields case. This former police officer reporter is embarrassed, and appalled, at the conduct I have seen coming out of the Oceanside Police Department, the San Diego County District Attorney's Office, and the Superior Court Judges.

As a citizen of Oceanside this reporter filed the following criminal complaint against Officer Domonique, DDA Rodriguez, and DDA Silva with the Oceanside Police under complaint #10006794. The complaint was also filed with the District Attorney's Office, and the California Attorney General's Office.

The criminal complaint and associated documents clearly tells the Michael Shields story. The complaints, as usual were ignored and suppressed by all public agencies for mutual protection, because all the criminals were wearing badges, and they are all connected to union manipulation of elections. Felony criminal complaints in writing, signed, and there was no follow up, investigation, and no accusations of false reporting.

Public complaints were also presented in front of the Oceanside City Council, on the Domonique criminal assault on the Shields family, to round out the public notifications. The Oceanside City Council, as in the past, suppressed complaints and investigations, and walked away to protect political careers, campaign finances from dirty cops and dirty firemen, and to avoid civil litigation that would consume tax dollar resources. Resources the police and firefighters would rather use in their union pay and benefits. All while multiple Police - DA's conspiracies to obstruct justice operated, and expanded in San Diego County, with full protection from the California Attorney General, and the FBI.
