The Federal Bureau Of Investigation is the nations top designated protector, of the three corner stones of our freedoms. Those corner stones are our protections from election crimes, public corruption, and civil rights violations. Between 2009 and 2012 the FBI has been directly involved in the cover up of First Responder Union Election Fraud, massive evidence tampering in criminal prosecutions by the same police and district attorneys, and large numbers of associated civil right violations to protect the corruption, in San Diego County, and Oceanside, California. More than a dozen agents of the San Diego and Washington D.C. offices of the FBI were given complaints and public record documentation on everything. The FBI actively obstructed, and suppressed all criminal complaints, and investigations, of an election fraud conspiracy, planned by, financed by, executed by, and protected by, more than two hundred Police Officers, Firefighter, District Attorneys, and elected officials.
More than 172,000 Oceanside, CA. citizens were criminally defrauded of millions of dollars, through election fraud, and it's associated campaign finance and campaign advertising fraud, designed by first responders to manipulate votes, and elections. The FBI protected the public corruption from investigation, because large numbers of the criminal were wearing badges. More importantly the same Police Officers and District Attorneys, had also been involved in large scale evidence tampering in criminal arrest, and prosecution, for more than 10 years. Numerous citizens were prosecuted and jailed for crimes they did not commit, while the evidence that proved their innocence, was hidden or destroyed. It is not know how many innocent people were sent to prison, to protect the corruption. Evidence tampering, and civil rights violations, so extensive, exposure could collapse the local justice system, and the FBI knew everything, and they have been covering it up for years.

This reporter made more than 36 phone calls, and face to face contacts, at FBI Offices during the three year period, with hard copy public record documentation handed to FBI agents. Dozens of e-mails were exchanged with attached complaints, and documentation, on the extensive public corruption. If any citizens tells you that it is easy for a citizen to file criminal complaints with the FBI, against police officers, district attorneys, and firefighters, then they lied to you. The FBI made it clear from the beginning, that they did not want to hear about large scale first responder public corruption. Less than one in twenty phone calls and e-mail contacts were ever returned. The FBI office in San Diego is operated like a fortress, where a citizen cannot even enter the parking lot, without an appointment, and all request for appointments from this reporter were rejected.

In common law, an accessory could not be found guilty unless the actual perpetrator was convicted. In most U.S. jurisdictions today, however, an accessory can be convicted even if the principal actor is not arrested or is acquitted. The prosecution must establish that the accessory in some way instigated, furthered, or concealed the crime. Typically, punishment for a convicted accessory is not as severe as that for the perpetrator
An accessory after the fact is someone who knows that a crime has occurred but nonetheless helps to conceal it. Today, this action is often termed obstructing justice.
In Criminal Law, contributing to or aiding in the commission of a crime. One who, without being present at the commission of an offense, becomes guilty of such offense, not as a chief actor, but as a participant, as by command, advice, instigation, or concealment; either before or after the fact or commission.
THE ELECTION FRAUD COVER UP HISTORY
In 2008 the Oceanside, California Police Officers, Firefighters, and their public unions wanted higher pay and more benefits, from a city whose debt was increasing annually, as a direct result of existing union contract obligations. For more than five years the firefighters and police officers unions had spent hundreds of thousands of dollars in multiple attempts to elect, and maintain, a three vote city council majority, that would protect the union jobs at all cost, and expand union pay and benefits on demand. Oceanside Police and Firefighters are among the highest paid first responders in the county. In January of 2008 the three vote sure thing union majority did not exist in the Oceanside City Council. The non-union controlled council members had blocked the hiring of three new firefighters, and they were talking about privatizing parts of the firefighters unions to save money, and reduce the city's budget deficit. Union job reductions that would dramatically reduce the union's finances, and their associated controls over elected officials, like Mayor Wood and Deputy Mayor Sanchez.
These issues were the foundation, for activation of the first responders election fraud conspiracy in January of 2009, and the three years of union election fraud conspiracy, and obstruction of justice that would follow. The Oceanside Police Officers, Firefighters, elected officials they controlled, and key citizens in multiple local PAC's would facilitate the falsification of campaign finance records, and the preparation and distribution of falsified campaign literature, to manipulate votes, and hide the election fraud. The Firefighters would coordinate the conspiracy, and the collection and distribution of the money, while the Police Officers would provide the protection from criminal complaints and investigations, with political cover from the mayor and key council members.

THE FBI ELECTION FRAUD COVER UP
In September of 2009 Agent Aguirre of the San Diego FBI office was initially contacted via telephone, with e-mail follow ups. Agent Aguirre was given criminal complaints with extensive documentation on the Oceanside Police and Firefighter election fraud conspiracy (ABOVE), the Oceanside Officer Damon Smith eight years of evidence tampering, and it's cover up to protect the election fraud. Additional information was provided on an insurance fraud scheme to expanded funding for union jobs, operating out of the San Diego DA's insurance fraud investigation division. Agent Aguirre was told that the hard evidence of the election fraud was in falsified campaign finance records, from multiple PAC's, by multiple PAC officials, and that copies were available from the city clerks office. Campaign finance record signed under penalty of perjury, in a coordinated criminal conspiracy between the Oceanside Firefighters Association Union officials, and multiple officers of two PAC's, that the OFA financially controlled. The manipulation of citizens votes, and city council votes in the recall petition drive was successful, and the the recall election was scheduled for December of 2009. This date would place the election two months in advance of the scheduled vote by the city council on the new union contracts.

There was no evidence of follow up or investigation by the FBI. There was no response to request for phone call backs, or e-mail responses. The FBI had hard evidence, and complaints of criminal conspiracy, by large numbers of Oceanside police officers and firefighters, to falsify and manipulate an election, and to tamper with evidence in hundreds of criminal investigations and prosecutions. The FBI also had hard evidence that the Police and District Attorney's Office was obstructing all complaints and investigations. There was no evidence of interest, or investigation by the FBI.
During this same time period, as Oceanside Chief of Police Frank McCoy was obstructing investigations of Officer Smith's audio tape evidence tampering, McCoy and the Oceanside police were also conspiring with other senior officers, to destroy audio tape evidence, and suppress the criminal investigation of Oceanside Police Sgt. Larson. Chief McCoy obviously knew he had full protection from the DA's office on the Smith evidence tampering, and the DA's office was actively obstructing justice in the Summer murder case law suit which did get filed in September 2009, and the FBI was no where to be seen.

In October of 2009 this reporters investigation disclosed the Deputy District Attorney Laura Gunn obstruction of justice, in the DA's investigation of the Officer Damon Smith evidence tampering. Officer Smith was being protected from arrest and prosecution, on extensive evidence tampering, to keep his mouth shut about the identity of other Oceanside Police Officers involvement in Smith's eight years of evidence tampering. DDA Gunn suppressed a witness to the involvement of other police officers, and the DA's office quickly shut down the Officer Smith investigation to protect prior prosecutions, and other on going DA criminal operations. When criminal complaints were filed against DDA Gunn, she was quietly terminated, and the complaints buried. Copies of the complaints and termination information were provided to the FBI. No one, including the FBI, ever contacted, and interviewed that witness, who was the criminal defense attorney, that had originally discovered the evidence tampering in court, with Officer Smith under oath.

On November 11, 2009 a written criminal complaint, with hundreds of pages of documentation on the Oceanside Police and San Diego DA public corruption, was delivered to Senior Assistant Attorney General Gary Schons, at the San Diego Department Of Justice. The complaint was quickly buried, and a two sentence letter issued, stating the AG's office saw no reason to investigate anything. Copies were sent to the attention of Agent Aguirre in the San Diego FBI main office. The FBI was given hard evidence and a witnesses name, that confirmed a senior Deputy District Attorney named Laura Gunn had obstructed justice in a criminal investigation of police evidence tampering, and it was covered up by a Senior Attorney General, and there was no evidence of investigation by the FBI. A criminal complaint against DDA Gunn had been filed in person, with DDA Damon Mosler of the DA's internal affairs, which was immediately buried by the DA's office, and there was no evidence of any FBI investigation, or follow up.

On December 8, 2009 the California Fair Political Practices Commission completed their investigation of the Oceanside Police and Firefighters Election Fraud conspiracy campaign finance records. The FPPC verified that two PAC's, financially controlled by the Oceanside Firefighters, had falsified their campaign finance records to hide the financial control of the of the OFA over the falsification of the campaign finance records, and the falsification of election literature in the election conspiracy. Warning letters were issued to four officers of the two PAC's and the documents were forwarded to the San Diego District Attorney for investigation and prosecution. Follow up contacts with the DA office disclosed there would be no investigation of the verified fraud, and no further comment, as the DA's office was extensively involved in evidence tampering and it's cover up with the same Oceanside Police Officers.

California FPPC Verifies GTI Complaint On Falsifications Of Campaign Finance Records In Police & Firefighter Election Conspiracy To Expand Union Pay & Benefits
Agent Aguirre of the FBI was provide documentation on the California State FPPC election fraud verification, and the DA's office obstructing the investigation and prosecution of a verified election fraud. Election fraud directly connected to, and financed by the Oceanside Firefighters, Police Officers, their unions, and elected officials. Follow up calls to Agent Aguirre disclosed no evidence of any FBI investigation, or any interest in an investigation.
The election fraud conspiracy, December 2009 vote, failed to recall Council Member Kern, and replace him with Charles Lowery. The criminally fraudulent recall election process defrauded the citizens of Oceanside of an estimated $500,000.00, which they did not have, and this did not include all the money donated by citizens to defeat the recall. The FBI had hard public record evidence that the entire process was a criminal election fraud, and there was no follow up, or evidence of any investigation, and the Police, Firefighter, and DA public corruption evidence tampering conspiracy was still active, and continuing.
Within days of the failed recall election vote, Council Member Chavez suddenly resigned, leaving a split council vote, and a open seat on the council. Council Member Chavez local business had been under attack from the firefighters, Mayor Wood, and Deputy Mayor Sanchez for years, and they almost force him out of business. All evidence indicates that Chavez had enough, and his vacant seat would now have to be filled by another special election, estimated to cost Oceanside citizens an addition $250,000.00. In January 2010 the first responders election fraud conspiracy was still active, the FBI was silent, and the new expanded union contract approval was still stalled, by the new two-to-two vote split on the city council, caused by the sudden resignation of Chavez.
The vacated council seat kicked the Police and Firefighter election fraud conspiracy, and the cover up of the associated police evidence tampering to protect their public image into high gear. The new election date was scheduled for June of 2010. Citizens that complained of the public corruption in council meeting were viewed as jeopardizing the second chance election manipulations, and the on going corruption cover up. The Mayor and council members conspired with police to seize, and removed citizens from the council meetings, if they complained publicly about the corruption, while Chief Of Police McCoy watched from the audience. Written criminal complaints were were filed with the police, and DA's office on the civil rights violations, with copies to the FBI. There was no follow up or investigation by the FBI, or any other law enforcement agency, on any of the assaults.

In late March 2010 the Oceanside Officer Jon Domonique and DDA Daniel Rodriguez audio tape evidence tampering surface. It had be on going since January of 2009, and was actively being suppressed in the DA's Special Operations Division with other police and DA evidence tampering cases. Another Oceanside police police officer, and another Deputy District Attorney, was hiding audio tape evidence in multiple criminal prosecution, while they prosecuted innocent people on felony crimes, that did not exist. Criminal complaints to Chief of Police McCoy, and all agencies, including the FBI, were ignored and buried, and the election fraud went forward.

In June of 2010 the eighteen month long election fraud conspiracy, with full law enforcement protection from investigation, succeeded with the election of Police and Firefighter hired gun candidate Charles Lowery. Lowery would fill the remaining six month term of Council Member Chavez's vacant council seat. This was followed by accelerated union contract negotiations, greased by the new three vote majority control of Mayor Wood, Deputy Mayor Sanchez, and Charles Lowery. The first group of expanded union contracts was quickly approved in September 2010, while the negotiation, and modifications, of the remaining union contracts continued behind closed doors. The citizens money losses, with the new expanded contracts, jumped from approximately one million dollars into multi-millions, for life of the three year contract, according to the non partisan study by the San Diego Taxpayers Association.

POLICE AND FIREFIGHTER ELECTION FRAUD CONSPIRACY TURN PURE GOLD
The police and firefighter public corruption conspiracy, and its cover up by the FBI, was still not over. Lowery had only been elected to fill out the remaining six months of the council seat, vacated by Chavez's sudden resignation. In November 2010 the Police and Firefighters unions failed to get Lowery re-elected for a full term, and they still had more union contracts to be approved. The problem was, there were no scheduled council meetings before Lowery left office, in which a legal vote could be registered to approve the additional union contracts. So Police and Firefighters unions conspired with Mayor Jim Wood, to call a special emergency council meeting, the day before Lowery left office, so he could vote with Mayor Wood and Deputy Mayor Sanchez, to approve all remaining union contracts. Lowery's reward was the police and firefighters immediately paid off all of Lowery's campaign debt, and his personal loans, in exchange for the contract votes, as he went out the door.

More than two years of Police, Firefighter, District Attorney, and elected official criminal conspiracy, in election fraud, evidence tampering, civil rights violations, and obstruction of justice in massive public corruption, documented in public record evidence, and the FBI did nothing. All three of the primary mandates of citizen protections were violated, and the FBI did nothing. Hundreds of police officers, firefighters, and district attorneys, had criminally defrauded hundreds of thousands of citizens, of millions of dollars. Hundreds of criminal prosecutions, if not thousands, were corrupted by police and DA evidence tampering, with civil rights violations to numerous to count, and the FBI did nothing.
The end of the election fraud, with the approval of all of the new expanded union contracts, unfortunately did not end other associated first responder and DA public corruption. More evidence tampering and obstruction of justice, with public record documentation, on the massive evidence tampering and it's cover up, would continue to surface in 2011 and 2012. The documentation would link District Attorney Bonnie Dumanis, and Oceanside Chief Of Police Frank McCoy, directly to evidence tampering conspiracies in a murder case, and orders to destroy evidence, and suppress investigations, of corrupt police officers. Secret DA documents would surface, that verified special protection agreements for corrupt district attorneys, if they resigned, and kept their mouths shut. One thing that did not change was the cover up of all of the public corruption, by agents of the Federal Bureau of Investigation.
