THE OCEANSIDE POLICE DEPARTMENT INTERNAL AFFAIRS DIVISION, OBSTRUCTED THE EVIDENCE TAMPERING CRIMINAL INVESTIGATION OF OFFICER DAMON SMITH, AND OTHER OCEANSIDE POLICE OFFICERS

This Reporter's two year undercover public corruption investigation, which involved the Oceanside Police Department, disclosed extensive criminal conduct, by multiple Oceanside Police Officers. As a citizen of Oceanside, California, and a former Police Officer, this reporters legal and ethical obligations were clear. When all attempts to verbally report police misconduct, and criminal conduct, to proper authority was obstructed and ignored by the OPD, this citizen began filing complaints in writing to establish a public record.

The complaints were signed, and police department signatures were required to confirm receipt of the complaints. The filing processes were recorded on audio tape to protect myself from false arrest, and false prosecution, as I had observed in other Oceanside Police cases.

During the two year investigation eight misconduct complaints, with criminal allegations and documentation, were filed with Sergeant Ron Hardy, supervisor in charge of the Oceanside Internal Affairs Division. Multiple follow up contacts with Sgt. Hardy during the two year period made it clear that no serious investigations were being done, of the officers involved in the complaints. None of the complaints were being referred out of Internal Affairs for criminal investigation, even though multiple violations had occurred.

This citizen reporter then started to file the written criminal complaints with OPD desk officer, with case numbers assigned, to insure that the Oceanside Police Department could not deny knowledge of the criminal complaints, involving multiple police officers. The Internal Affairs had a practice of burying all complaints, and blocking public record request follow up, by abusing state laws on privacy of police officers. Copies of the criminal complaints were filed with the District Attorney, and the Attorney Generals Office.

There was no follow up, by any investigator, from any office, and no evidence that any criminal complaint involving Police Officers, or District Attorney Prosecutors were ever investigated. All public records request to the Police Department, City Attorney, Attorney General, and District Attorneys Office for information on any investigation of the criminal complaints were denied, citing state privacy laws involving police officers, and "that release of the information was not in the best interest of the public".

The Public Records Request did produce a few documents. One of which was obviously not intended for release. On first appearance the document appears to be just an e-mail request, dated May 21, 2009, to Officer Damon Smith, from a North County Times reporter named Terri Figueroa, requesting a follow up interview.

Figueroa was the reporter that initially discovered Officer Smith's secret practice of recording criminal investigations on audio evidence tapes, and hiding them from the criminal justice system. The document header and accompanying message shows, Officer Damon Smith forwarded the e-mail from reporter Figueroa, to Sgt. Ron Hardy, head of the OPD Internal Affairs Division. Officer Smith writes, "There was also a call. How would you like me to respond to this?"

It has only been a few weeks since Officer Smith was caught, under oath, testifying about his eight year scheme of evidence tampering in criminal investigations. Sgt. Hardy is the Internal Affairs Officer that is suppose to be investigating Officer Smith for potential involvement in hundreds of felony crimes. The so called District Attorney Special Operations Investigation has just been assigned to DDA Laura Gunn. Officer Smith is asking Sgt. Hardy, how Hardy would like Smith to respond to press interviews. A real Internal Affairs investigation has the potential of putting Officer Smith in prison for years, and the suspect police officer Smith, and the investigating Internal Affairs officer Sgt. Hardy, are trying to decide how to handle the press.

There was never an investigation of Officer Damon Smith, because the OPD, and the District Attorney, knew that Officer Smith had the names of other police officers involved in eight (8) years of evidence tampering. Evidence tampering, by multiple police officer and district attorneys, that could adversely impact thousands, of previously prosecuted criminal cases.

This was later verified when DDA Laura Gunn, head of the DA's special investigation, suppressed a witness, to the involvement of other Oceanside Police Officers, and closed the investigation. This was done in conspiracy with DA Dumanis and DDA Damon Mosler to protect Dumanis, Gunn, and the DA's office from a $20 Million dollar law suit, and a criminal investigation for evidence fabrications in the Cynthia Sommer murder case.

The Oceanside Police Department protected Officer Smith from criminal investigation in 2009, primarily to protect the on going covert election fraud conspiracy, by the police and firemen, to expand their pay and retirement benefits.

The cover up was also supported by members of the Oceanside City Council, to protect political careers, and hundreds of thousands of dollars in campaign financing from the Police and Firemen.
