CRIMINAL COMPLAINT #11005500 WITH DOCUMENTATION FILED WITH OCEANSIDE POLICE WAS BURIED

On November 2, 2010 the Oceanside Police and Firefighter election fraud conspiracy, to expand pay and benefits, hit a snag. Open pocket Council Member (CM) Charles Lowery failed to get re-elected in the general election. Even with the corrupt police protection, and massive financial support of the Oceanside Police and Fire Departments, and other public unions.
The election tampering conspiracy that had started in late 2008, to restructure the city council votes for new expanded union contracts, succeeded in June of 2010 with the special election of union hired gun Charles Lowery. Lowery got elected to fill the remaining six months of CM Chavez's term. CM Chavez was under financial and political attack from Police and Fire Unions, and their hired guns Mayor Jim Wood and Deputy Mayor Esther Sanchez. Chavez choose to resign from the council, and flee the city, after the initial Kern Recall Election conspiracy failed in December 2009. All complaints of corruption and criminal conduct by the Police and Firefighter unions was suppressed by the Oceanside Police, and the San Diego DA's Office, while Mayor Wood and Deputy Mayor Sanchez provided Ciry Council protection.
The election of Lowery in June of 2010 moved the long stalled Police and Fire Union contract negotiations into high gear. As the corrupt Police and Fire Department unions now controlled the council votes necessary for expanding pay and benefits. The public vault was wide open. By September, the long stalled, enhanced union contracts were ready, and quickly approved by newly elected CM Lowery, Mayor Jim Wood, and Deputy Mayor Esther Sanchez.
Oceanside Citizens existing annual debt, of approximately four million dollars, mostly due to existing union obligations, exploded with the new contracts. Even though there was no foreseeable sources of revenue to pay the bill. Two special elections, forced by the Police and Fire corruption, had already cost Oceanside Citizens an estimated $700,000 in special election cost, that they did not have. Millions in new debt would soon be pushed into long term bond obligations by the corrupt trio, so they could later falsly claim the new contracts had reduced the cities debt.

OCEANSIDE POLICE & FIRE PUBLIC UNIONS ELECTION FRAUD & EVIDENCE TAMPERING CONSPIRACY TO EXPAND PAY AND BENEFITS
This was only the beginning of the bad news for Oceanside citizens. The Police and Fire Unions had more contracts, with enhanced pay and benefits for other departments, that they wanted approved as soon as possible. The negotiations for the Police and Fire Management Associations were now the priority of the Police and Fire Unions, and their hired gun Mayor Jim Wood, as there was less than two months till the regular general election. The Police and Fire Unions understood the Lowery re-election campaign could fail, as had the CM Kern Recall Election conspiracy. There was little chance of forcing CM Kern, or CM Feller, to resign and leave town as CM Chavez had fled. The Unions worst fears were realized when Oceanside citizens recognized the corruption and rejected CM Lowery five months later.
CM Lowery's loss of the general election on November 2, 2010 was a major blow to the unions plans, considering the amount of money and protection resources, that had been spent on the election fraud. The Police and Fire Unions had less than 30 days, before Lowery would be replaced, by newly elected CM Gary Felien. Felien had already stated opposition to the expanded union contracts.
The union's problem was the Police and Fire Management contracts would not be ready for a City Council Vote until the end of November. Even if they were, there were no scheduled council meeting after November 8, that would provide a legal way, for lame duck Lowery's vote to approave more new union contracts. The Police and Fire Departments had spent a small fortune putting Lowery on the council for just six months, and they wanted all of those new contracts approved before Lowery left office, in such a way, that they could not be reversed by the new non union City Council.
Co-Conspirator (Accessory)
In common law, an accessory could not be found guilty unless the actual perpetrator was convicted. In most U.S. jurisdictions today, however, an accessory can be convicted even if the principal actor is not arrested or is acquitted. The prosecution must establish that the accessory in some way instigated, furthered, or concealed the crime. Typically, punishment for a convicted accessory is not as severe as that for the perpetrator
An accessory after the fact is someone who knows that a crime has occurred but nonetheless helps to conceal it. Today, this action is often termed obstructing justice.

One who, without being present at the commission of an offense, becomes guilty of such offense, not as a chief actor, but as a participant, as by command, advice, instigation, or concealment; either before or after the fact or commission.
The failed Lowery campaign had over $24,000 in unpaid bills, and just over $14,000 in current donations. Lowery would be out of office on December 2, and he was more than $10,000 in debt. Part one of the conspiracy solution was three days after the general election, on November 5, the Oceanside Police Department quickly donated $10,000 in cash to Lowery's failed re-election campaign, which just happened to be $10,000 in debt. Lowery's campaign debt also included a $2,000 personal loan from Lowery to his campaign, made back in October 2010. The sudden generosity of the Oceanside Police Officers wiped out the campaigns excess debts. It also allowed Lowery to recover the $2,000 in personal loans he made to his campaign. The bonus was that once again, as in the past, campaign finance law reporting cycles could be abused to hide the $10,000 payoff. No one would know about the public corruption until after the votes on more expanded union contracts, and after the first of the year, when Lowery would be gone. The main line news media had ignored the campaign finance records for two years. Many reporters and major news groups had directly conspired with the dirty Cops, and Firefighters to hide the election fraud, in exchange for cash payments, and all evidence indicated they would probably continue to do so.
During the same protected campaign finance reporting cycle, the Fire Department Union was also channeling money through outher back doors to further reduce Lowery's debt obligations, while hiding the source of the money in other campaign finance records. The Fire Department Union was arranging for cash kick backs from out of area businesses, that the Fire and Police unions use to support their election frauds. The Fire Union paid $2,000 to Progressive Solutions Consulting in Long Beach, Ca. for consulting fees. Progressive Solutions donated $999.00 of the $2,000 back to the Lowery campaign to help Lowery pay off his debts. The falsification and manipulation of campaign finance records, and election laws, was used extensively by the Police and Fire Unions to hide the dirty money trails in the Kern Recall Election Tampering, which had leed to the special election of Lowery in the first place.
The solution to the problem of no available council meeting for Lowery to cast his $10,000 votes, on more expanded Police and Fire pay and benefits, was already paid for, and waiting in the wings. It seems that one individual, has the legal power to call EMERGENCY City Council Meeting on a twenty-four hour notice. That person is x-Oceanside Police Officer, Co-Conspirator, Mayor Jim Wood, whose vote has been paid for many time, with nine years of unlimited campaign financing by the Oceanside Police and Fire Department Unions. Mayor Wood decided that pushing the remaining unapproved union contracts throught the council votes, before Lowery left, was an CITY EMERGENCY.
On November 30, 2010, Mayor Jim Wood, in conspiracy with the Oceanside Police and Fire Unions, issued a notice of a special City Council Meeting for December 1, 2010, the last day in office for CM Charles Lowery. Lowery promptly provided the required MAJORITY vote, with Mayor Jim Wood and Deputy Mayor Esther Sanchez, to approve more expanded Police and Fire pay and benefits. Expanded pay and benefits that the citizens of Oceanside can only pay for, with increased taxes and fees, and major cuts in public services. Lowery walks away with all of his campaign debts erased, and a cool $2000 back in his pocket. Once again the criminal corruption of Oceanside's first responders and the corrupt city council had successfully defrauded the citizens of Oceanside of millions of dollars, and they lined their pockets with dirty money from dirty police officers and dirty firemen at the same time.
All complaints of criminal and public corruption were suppressed and buried by the Oceanside Police, and all city council members. The San Diego District Attorneys Office supported the corruption cover up to protect eight years of DA and Oceanside Police evidence tampering corrupting hundreds, if not thousands, of criminal prosecutions. DA Dumanis's was also hoping to keep a clean public image to run for Mayor of San Diego in 2012, but it appears it's a little late in the game for Dirty DA Dumanis. DA Dumanis was also suppressing other evidence tampering criminal investigations to protect herself from a criminal investigation, and $20 Million dollars in civil liability, for more evidence tampering in the Cynthia Sommer Murder prosecution.
